Terms of Service

These Terms of Service ("Terms") govern your use of Tree Studio ("Service"), operated by Nilmot Solutions LLC d/b/a NuSoftVA ("we", "us", or "our"). By accessing or using Tree Studio, you agree to these Terms.

1. Use of the Service

Tree Studio allows you to create, save, share, and embed hierarchical tree diagrams. You may use the Service for any lawful purpose, personal or commercial, subject to these Terms.

You agree not to:

• Use the Service to store or distribute unlawful, harmful, or infringing content
• Attempt to reverse-engineer, scrape, or overload the Service
• Misrepresent your identity or affiliation
• Use automated means to access the Service beyond normal API usage covered by your plan

2. Accounts and Authentication

Tree Studio uses GitHub for authentication. You are responsible for maintaining the security of your GitHub account. We are not responsible for any loss resulting from unauthorized access to your account.

3. Subscription Plans and Billing

Tree Studio offers Free, Pro, and Business plans. Paid plans are billed monthly or annually. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by law.

We reserve the right to change pricing with 30 days' notice. Continued use after notice constitutes acceptance of new pricing.

4. Your Content

You retain full ownership of any tree data you create and store using Tree Studio. By saving trees to the cloud, you grant us a limited license to store and serve that content solely for the purpose of providing the Service to you.

We do not sell, share, or use your tree content for any purpose other than operating the Service.

5. Free Tier Limits

Free tier accounts are limited to 3 saved trees. Trees beyond this limit may not be saved until existing trees are deleted or your account is upgraded.

6. Shared and Embedded Trees

When you generate a share link or embed code for a tree, that tree becomes publicly accessible to anyone with the link. You are responsible for the content of shared trees. You can revoke access at any time by deleting the tree from your account.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes at any time. We are not liable for any loss resulting from downtime.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting us at contact@nusoftva.com.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Nilmot Solutions LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or a notice in the application. Continued use constitutes acceptance.
